Types of Data collected

The Personal Data collected by Bortolomiol, either on its own or through third parties, includes: email; tracker; User data; unique device identifiers for advertising (Google Advertiser ID or IDFA identifier, for example); Data given while using the service; name; surname; geographical location; gender; telephone number; address; password; VAT number; country; city; various types of Data.

Personal Data may either be given freely the User or, for User Data, collected automatically when using the website. Unless otherwise specified, all Data requested by Bortolomiol are obligatory. If the User refuses to provide them, it may be impossible for Bortolomiol to provide the service. Where Bortolomiol states certain Data are optional, Users are free to decline to provide such Data without this having any effect on the availability of the service or on its functionality. Users who have any doubts regarding which Data are obligatory should contact the Controller. Any use of cookies – or other tracking tools – by Bortolomiol, unless stated otherwise, are used to provide the service requested by the User, as well as for other purposes described in this document and in the Cookie Policy, if available.

The User assumes the responsibility of third party Personal Data obtained, published or shared by Bortolomiol and guarantees they have the right to communicate or circulate them, absolving the Controller of any liability towards third parties.

 

Processing methods and place where the Data is processed

 

Processing methods

The Controller will adopt the appropriate security measures to prevent unauthorised access, disclosure, modification or unauthorised deletion of the Personal Data. The Data will be processed by electronic and/or telematic means, with organisational methods and logic strictly in keeping with the purposes stated. As well as the Controller, in some cases other persons involved in the Bortolomiol organisation could have access to the Data (administrative, commercial and marketing staff, legal advisors, system administrators) or external persons (such as suppliers of technical services, postal couriers, hosting providers, IT companies or advertising agencies) also appointed as Data Processors by the Controller. An updated list of Processors can always be requested from the Data Controller.

 

Lawful basis for processing Data

The Controller processes the User’s Personal Data where one of the following conditions is present:

  • The User has given their consent for one or more specific purposes; Note: in some judicial systems the Controller may be authorised to process Personal Data without the User’s consent or another of the lawful bases specified hereafter, until the User opts out. However this does not apply where the processing of Personal Data is regulated by European laws on the protection of Personal Data;
  • the processing is necessary to execute a contract with the User and/or to execute pre-contractual measures;
  • the processing to discharge a legal obligation with which the Controller must comply;
  • the processing is necessary to execute a duty in the public interest or to execute public powers granted to the Controller;
  • the processing is necessary to pursue the legitimate interests of the Controller or third parties.

The Controller can however always be requested to clarify the actual lawful basis for each processing and in particular to specify whether the processing is based on law, required by a contract or necessary to conclude a contract.

 

Place

The Data are processed on the Controller’s business premises and anywhere else the parties involved in the processing are located. For more information, contact the Controller. The User’s Personal Data may be transferred to a different country from the one where the User is located. To receive more information on the place where the Data is processed, the User can refer to the section containing the details on the processing of Personal Data.

The User has the right to obtain information regarding the lawful basis for the transfer of Data outside the European Union or to an international public legal organisation or made up of two or more countries, such as for example the UN, as well as regarding the security measures adopted by the Controller to protect the Data. The User may check whether a transfer such as those described above takes place by referring to the section of this document that covers the details of the Personal Data processing or the Controller can be contacted for information using the contact details given at the start of this document.

 

Storage period

The Data are processed and stored for the time necessary for the purposes for which they were collected.

Therefore:

  • Personal Data collected for purposes to do with the performance of a contract between the Controller and the User will be kept until said contract has been completed.
  • Personal Data collected for purposes to do with the legitimate interests of the Controller will be kept until those interests have been fulfilled. The User may obtain further information regarding the legitimate interests pursued by the Controller in the relative sections of this document or by contacting the Controller.

When the processing is subject to the User’s consent, the Controller may keep the Personal Data for a longer period until the consent is withdrawn. Furthermore, the Controller may be obliged to keep Personal Data for a longer period to comply with a legal obligation or by the order of an authority. At the end of this storage period the Personal Data will be erased. Therefore, once this period has expired the right to access, erasure, rectification and the right to Data portability may no longer be exercised.

 

Purposes of processing the Data collected

The User’s Data are collected in order for the Controller to be able to provide the service, comply with legal obligations, respond to requests or executive actions, safeguard their rights and interests (or those of Users or third parties), identify any malicious or fraudulent activities, as well as for the following purposes: Contacting the User, Remarketing and behavioural targeting, Statistics, Advertising, Registration and authentication, Viewing content from external platforms, Accessing accounts on third party services, Managing tags, Content and function performance testing (A/B testing), Heat mapping and session registration, Monitoring the Infrastructure, Commenting on content, Interacting with live chat platforms, Managing the collection of Data and online surveys, Processing payments, Managing support and contact requests, Managing productivity activities, hosting and platform services, Registration and authentication provided directly by Tannico and the transfer of Data outside the EU.
